Please reference the scope of work and attachment(s) for the full details of this project.</p><p>Please read through all of the solicitation as the City expects to fund a portion of this project with a loan from the Illinois Environmental Protection Agency (IEPA). This will require acknowledgement and/or other documents to be uploaded for bid submission in addition to the forms normally included in City bids.</p><p>Neither the State of Illinois nor any of its departments, agencies, or employees is or will be a party to this invitation for bids or any resulting contract. The solicitation and procurement will be subject to regulations contained in the <span data-olk-copy-source=\"MailCompose\">Procedures for Issuing Loans from the Public Water Supply Loan Program (35 IAC Part 663)</span> , the Davis-Bacon Act (40 USC 276a - 276a-5) as defined by the United States Department of Labor, the Employment of Illinois Workers on Public Works Act (30 ILCS 570), the Illinois Works Jobs Program Act Apprenticeship Initiative (30 ILCS 559/20-1), and the Federal &ldquo;Build America, Buy America Act requirements contained in the Infrastructure Investment and Jobs Act, Publ. L. No. 117-58. This procurement is also subject to the loan recipients' policy regarding the increased use of disadvantage business enterprises. The loan recipient's policy requires all bidders to undertake specified affirmative efforts at least sixteen (16) days prior to bid opening. The loan recipient's policy for this project is contained in the specifications. Bidders are also required to comply with the President's Executive Order No. 11246, as amended. The requirements for bidders and contractors under this order are explained in 41 CFR 60-4. This project qualifies for the statutory American Iron and Steel (AIS) requirements of Clean Water Act (CWA) Section 608 and Safe Drinking Water Act (SDWA) Section 1452(a)(4) as previously applied to SRF projects will continue to do so as part of the BABA requirements.</p><p>The proposed work to be performed in the City of Bloomington IL is bordered by West Oakland Avenue (North), Summit Street (West), Bunn Street (East), and East Lafayette Street (South). The project consists of the replacement of approximately 650 lead service lines and associated items.</p><p>The City adopted an Ordinance amending Chapter 16 of the City Code regarding public works contracts and project labor agreements. For all public works projects estimated in excess of $50,000 where public funds will be expended, the City of Bloomington shall require a project labor agreement unless it has been determined that a project labor agreement would not advance the City's interest of cost, efficiency, quality, safety, timeliness, skilled labor force, and labor stability and the City's policy to advance minority-owned or female-owned business, or businesses utilizing minority and female workers. The terms of any project labor agreement shall not exceed the economic standards established by the Illinois Prevailing Wage Act, as form time to time amended, nor contain any requirement of union membership of any contractor's employees or fair share payment by contractor's employees.</p><p>Project Labor agreement shall not be required for contracts for private development between the City and developers involving private business development activities (e.g., incentive agreement with developers on private development projects).</p><p>&nbsp;</p>",
