Description
Massachusetts General Law Chapter 25A Section 14 allows a limited exemption from public procurement law for energy conservation projects costing less than $300,000 in total project costs. Public entities may contract with investor-owned utility companies and their subcontractors to implement these energy conservation projects, directly and without further solicitation. The MBTA Chapter 25A Energy Conservation Program shall establish and maintain a list of qualified vendors able to deliver full turn-key services for energy efficiency projects under M.G.L. Ch. 25A §14. At the MBTA’s discretion, additional qualified vendors may be added on a periodic basis. The MBTA expects to complete 12 – 15 projects per year. The contract term will be from contract execution until February 28, 2029, provided, however, that M.G.L. Ch. 25A §14 remains in effect during the contract term. Contractors are required to maintain eligibility under 25A §14 during the contract term.
