PROJECT BACKGROUND The Tourism and Regional Infrastructure Project (TRIP) aim to boost Armenia's tourism potential through targeted infrastructure and soft investments in several regions. It will support seven of the twenty identified tourism clusters, focusing on wine, wellness, adventure, culture, education, and ecotourism across Ararat, Vayots Dzor, Shirak, Tavush, and Syunik regions. The project will improve connectivity to these clusters and enhance tourism site infrastructure. It also seeks to elevate Armenia’s natural assets and human resources, improving business and professional skills in nearby communities to maximize the job creation. Additionally, TRIP aligns with the World Bank’s approach to attracting private investment in these tourism clusters. Infrastructure investment component of TRIP include construction of new public buildings including museum buildings, restoration and preservation of historical monuments, urban regeneration of old towns and villages, including restoration of building facades, public spaces, museums, roads and enhancement of cultural and natural heritage sites, including access and presentation. Overall management and coordination of implementation and supervision of Project will be executed by the Armenian Territorial Development Fund (CLIENT). The present terms of reference describe consulting services for supervision of civil works under TRIP sought by the CLIENT. The consulting services ("the Services") include daily supervision of the civil works. The civil works contracts to be supervised will include a variety of works, such as construction of new and restoration of existing buildings and cultural heritage monuments/sights, touristic infrastructure, as well as municipal water/wastewater systems, lighting, local roads and utility services. 2. OBJECTIVES The purpose of construction supervision is to execute technical supervision over the civil works to ensure high quality of the civil works, adherence to the terms of work execution provided for in the construction contracts in compliance with the detailed design and specification requirements, to ensure the reliability, long-term sustainability and efficient operation of the civil works. The main objective of the assignment is the daily supervision of the construction or/and rehabilitation works, as the Technical Supervision Consultant (Consultant) on behalf of the CLIENT in accordance with the provisions of the signed contracts between CLIENT and Contractors in order to ensure the following: a) High quality of construction in adherence to the valid standards, regulations and laws of Armenia and international standards and best practices; b) Adherence to the requirements of valid design (draft, detailed), specifications and performance standards by implementation of the provisions of the technical specifications and other provisions of the works contracts; c) Adherence to the national environmental, social and labor legislation and regulations, and the World Bank’s ESF, and relevant Environmental and Social Standards (ESSs) applicable to TRIP, as well as the site-specific Environmental and Social Management Plans (ESMPs) to be prepared for subprojects; d) Completion of works in accordance with the works schedules and contracts price. The tentative duration of this assignment is 30 months, plus defects liability period after completion of each civil work contract. 3. SCOPE OF SERVICES Overall, the administration, execution and oversight of the “Civil Works to be implemented under the TRIP” will be organized via contract in three standard roles: Employer, Contractor, and Technical Supervision Consultant ATDF acts as the Client carrying out the overall and contractual coordination of the Project. The Contractor executes the construction works. The Consultant carries out daily technical supervision. The Consultant shall review, assess, and provide recommendations on all engineering matters and technical decisions necessary for the efficient, timely, and successful implementation of the civil works contract, for the consideration and approval of the Employer. The Consultant is directly responsible for daily supervision and immediate contacts with the works Contractors. Consultant will closely liaise with the Project Implementation and Supervision and Technical Supervision Departments of ATDF (CLIENT) to solve issues. Consultant should ensure strict adherence of Contractors to the requirements of detailed designs, technical specifications, site-specific EMSPs, and Resettlement Plans (RPs). The Consultant is responsible for mobilizing a team in compliance with the requirements and phases outlined below. The obligations include: providing all necessary personnel on site (engineers, supervisors, quality inspectors, environmental and social specialists, occupational health and safety (OHS) etc.) for the supervision of works, inspection and installation of the equipment, testing of construction materials, and monitoring the implementation of ESMPs and reporting. Within ten (10) days after the signing of the Civil Works Contract the Consultant shall submit the detailed work plan of the technical supervision services (including scope of duties of each specialist of Consultant’s team) for Client’s approval. The Work Plan shall be aligned with the construction phases and tentative implementation schedule as well as a cost estimate indicating anticipated input (workday) of each specialist and covering all the costs related to supervision services. Before the approval of the design documentation conduct a comprehensive, critical review of the proposed designs for each component by validating the necessary information obtained through Cadaster, local municipality, respective utility companies, etc. and via visiting the location of the contract site physically – and present written recommendations in the Inception Report regarding any necessary design changes or design aspects, which may pose implementation problems or unintended results during works. 4. GENERAL AND SPECIFIC TASKS 4a. General Task The tasks of the Consultant will include but not be limited to the following: Preparing a construction supervision work program to be prepared early during the Consultant’s contract commencement. Throughout the construction period, the Consultant shall undertake technical inspections and measurements to verify work quantities, maintain records of civil works, and certify completed works in accordance with reporting formats approved under the Contract. On a monthly basis, the Consultant shall prepare and submit to the Employer a report on quality-related issues, test results, non-compliances, identified defects, corrective actions and their resolution/implementation status. Reviewing the Contractors' payment certificates and giving respective feedback to CLIENT prior to approval by the latter; Verify the compliance between quantities and quality of executed works with the design and technical specifications; supervising adherence to the program and schedule of works to be executed by the Contractors; Supervising progress of preparation works (in accordance with the RA Construction Norms (RACN) 13-05-2026 "Organization of Construction Operations" and Order No. 09-A of the Chairman of the Urban Development Committee of the Republic of Armenia, dated 9 February 2023) to be executed by the Contractors, including construction of temporary structures in compliance with the work execution program and adherence to the terms provided for in the schedule; check and ensure that the Contractor has obtained all necessary permits and approvals from state and local governments, as well as utilities providers; and reporting, in writing, to the CLIENT. Check the safety of the works, property and personnel, and public in adherence to RACN regulations and TRIP site-specific E&S instruments. Checking the compliance certifications of the construction materials used in construction (cement, aggregates, additives, reinforcement, metal constructions, precast concrete, bitumen, asphalt concrete elements, mineral materials, electrical cables, and water supply pipes,etc.), checking compliance of manufacturers’’ factory sample analysis and laboratory testing data with requirements of technical specifications and RACN; Reviewing and approving that installed equipment meets the specifications defined under the detailed design; Inspect compliance of as built drawings submitted by Contractors (endorsed by signature and sealed) with the executed works; Maintain a daily technical supervision register of works, implemented by the Contractor making appropriate entries in the Construction Log maintained by the Contractor, recording observations, identified defects, and the measures taken for their rectification; receiving and concluding the phases of completed works with proper documents (certifications for hidden works, tests and other documentation); Conduct daily photography and video recording of construction activities performed, including these materials in the monthly reports and providing these materials upon Employer’s request. ; Certify completed stages of the Works in accordance with the format developed by the Consultant and approved by the Employer. Subject to the Employer’s approval, organize and supervise any additional unforeseen independent testing required to verify the final quality and compliance of the Works executed by the Contractor; In case of detecting defects or deficient works, compile a punch list setting deadlines for their rectification, immediately notify the Client in writing and monitor the rectification of these deficiencies. Observing and reviewing sampling, measurements and tests conducted by the Contractor (such as pressure tests for leaks) ensuring that the relevant records are prepared, for any works that are about to be covered or put out of view. In the event of identification of non-conformity with the RACNs, design requirements and/or specifications, prohibit the continuation of the works or the use of the materials, document such cases through appropriate formal records/acts and notifying the Employer in writing. Ensuring that Contractors have a good command of the requirements laid out in ESMPs, tracking adherence of Contractors’ performance with the ESMPs, and advising on and following the implementation of the corrective actions in case of identified environmental and social non-compliances; Supervise Contractors’ compliance with labor management requirements, including enforcement of Codes of Conduct and the functioning of the workers’ grievance mechanism (GM) in line with Project Labor Management Procedures (LMP). Reviewing and making recommendations to the CLIENT Supervision Engineer for any requests for variation or change orders, and Contractors’ claims. Submitting periodic reports to the CLIENT in accordance with the requirements outlined in the Chapter on “Reporting” and Chapter on “Preparation of Reports and Submission Dates” of these TOR. Check and monitor the implementation of occupational safety briefings conducted by Contractors (in accordance with Inter-state Standard GOST 12.0.004-2015). 4b. Specific Tasks The Consultant shall provide the following services under the direct guidance of the CLIENT: Inspect Contractors’ camps and temporary structures/buildings, storage areas, equipment and machinery to verify compliance with the applicable RACNs and detailed design requirements; Inspect quality and quantity of earthworks and foundation preparation: dimensions of foundation pits, trench’s cross sections, sand bedding, backfilling, quality of compacted fills, levels; gravel beds; lean concrete layers and etc; Supervise progress of concrete and reinforced concrete works. Inspect formwork dimensions, installation accuracy, quality, location of reinforcement and embedded parts, review of mix design, proper placement of concrete and testing resultant concrete strength, compliance of welded joints with the applicable RACNs; Supervise installation and repairs to the precast reinforced concrete constructions as well as inspection of dimensions, quality and placement of reinforced concrete elements, joint fillers, pads, water stops and other materials; Inspect reconstruction-restoration of buildings (architectural and structural parts); check conformance of supplied materials to the design requirements, specifications, and quality standards; inspect the workmanship of architectural and decorative elements of buildings; ensure application of the specified and approved technologies and materials; supervise strengthening of fundaments, supporting structures, seismic belts, change of roofs, building façade improvement containing brick finishing, plastering, changing of cornices, etc., rehabilitation of wooden, metallic and concrete balconies; rehabilitation of roofs (tile; soft roof, metal), rehabilitation of doors and windows, masonry works; Supervise and inspect road’ rehabilitation works: roadway pavement (different materials) layout of sidewalks, curbs, trails street furniture and etc.; Inspect installation of power cables, electrical equipment, lighting of streets, squares and parks; Inspect installation works of pressure and gravity pipelines (water supply, sewage, storm water) constructed of various materials (steel, cast iron, r/concrete, PE, PVC, etc.) including inspection of gradients, joints, fittings and other accessories in accordance with construction codes and contract specifications and verify the conduct and availability of the observance and certification of pressure and other tests, including laboratory testing where applicable, to ensure that leakage, if any, does not exceed limits as provided under the technical specifications; Supervise progress of installation, mechanical and electrical equipment; after completion of interim phases of construction, test equipment together with Contractors and the CLIENT’s Supervision Engineer and certify that the tests met the requirements of the technical specifications; Inspect construction of water supply headworks, pumping stations, raw water treatment and wastewater treatment plants including start-up and commissioning of electrical and mechanical equipment; prior to the commissioning stage, review and approve the updated/detailed functional testing method and schedule submitted by the Contractor in line with the design specifications ; checking the results of functional tests; Check the installation of the pressure and gravity pipelines (waterlines, sewage, storm water) and laboratory/pressure test reports in accordance with the RACN; Inspect certificates of construction materials and equipment used during construction (electrical and mechanical equipment, pipes, valves, fire hydrants, flow meters, fittings, cement, inert materials, admixtures, reinforcement steel, metal-ware, pre-cast reinforced concrete elements, wooden and ceramic materials, road pavement materials and etc.); correspondence of data on sample analysis (carried out by the manufacturer in the factory) and laboratory tests to the requirements of the technical specifications and correspondence of construction materials used for restoration/conservation of physical cultural resources to the specifications and technological requirements of such works; Monitor implementation of E&S mitigation measures in line with site-specific ESMPs in the course of works at each construction site; promptly notify the CLIENT on any deviations/violations of ESMP requirements, on any complaints from local communities related to ongoing works, and on any unforeseen issues affecting environment and/or cultural heritage which may emerge in the course of works; recommend remedial and/or corrective measures to the CLIENT and follow up on their application upon the CLIENT’s approval; Oversee temporary on-site storage and final disposal of construction waste to the formally assigned sites or landfills and on the reinstatement of work sites upon completion of activity at any given one; Support effective implementation of Project Feedback and Grievance Redress Mechanism (FGRM) at the local level in accordance with the Project Stakeholder Engagement Plan (SEP) and notify Project Coordinator on any issues appeared at the site. Inspect and oversee the implementation of by Operational Health and Security (OHS) measures, at the construction site, including the safety of structures used for work at heights and the proper use of appropriate PPE in accordance with site-specific ESMPs. Oversee implementation of community health and safety measures in accordance with site-specific ESMPs, including site safety, access control, traffic management, and ensure that community complaints related to health, safety, and nuisance are properly recorded, addressed, and reported through the FGRM. Verify that site-level information disclosure measures are in place, including appropriate signage and FGRM contact details, and verify that any access restrictions and safety requirements are clearly communicated to nearby residents in accordance with site-specific ESMPs. Promptly inform the Client about any accident and incident related to the project within 24 hours, that may have adversely affected the environment, communities, public or workers, for instance labor or transport related accidents that might result in serious injuries etc; participate in incident investigations and related reporting, as required by the Client, in line with the ESCP and applicable incident reporting procedures. 5. REPORTING At the outset of the contract commencement, the Consultant shall elaborate a reporting system (systematic registration and submission of the appropriate documents) CLIENT to provide regular, complete and detailed information to the CLIENT on progress and quality of civil works. The Consultant shall submit to the Client the following reports: Monthly Progress Report summarizing progress with the construction activities, problems encountered, updated planning, status of ESMP compliance and any outstanding issues deemed important by the Consultant. These reports shall have appended to them the daily technical supervision register of works (See item 13 of General Tasks) and filled out monthly environmental and social monitoring forms, as well as the physical and financial progress report for each CW site, along with the forecast for the next period. Special reports as may be required if there are one or more problems that require immediate attention of the CLIENT. Quarterly report on the period of work indicating progress on each subproject, course of activities, implementation of ESMPs, and any proposed changes to the work plan; As built-drawings prepared by Contractors and confirmed by Consultant; Final Project Completion report including Civil work contract data, contract variations, a table of actually completed works and disbursed funds by month, photographs, general comments on the Contractor's performance, an environmental and social final report, the results of the Acceptance Commission's work. 5a.Preparation of Reports and Submission Dates The above reports shall be presented in according to the following requirements: All reports shall be prepared in Microsoft Word and Excel, and presented to the CLIENT as bound documents according to agreed quantities (see table hereafter), in both hard copies and electronic files. Drawings will also be provided in hard copies and electronic forms (AutoCAD or compatible software). Reports should have attachments such as video and photo materials about the activity progress as evidence. The reports should be submitted in Armenian and English languages. INPUT BY CLIENT The CLIENT shall provide the Consultant with detailed design documentation, technical specifications, Project Environmental and Social Instruments, including the ESMPs, and other available documents needed for proper implementation of construction supervision for each subproject. ATDF will appoint its own specialists/engineers for each subproject, who will work closely with the Consultant and perform contract management and final decision-making functions.
