(1) Vendor needs to provide outside counsel services for real property tax assessment review to the government authority located in Albany, NY.– Reviewing petitions, notices of petition, applications for correction or reduction of assessments, and related pleadings and correspondence;– Preparing and filing answers, objections, motions, discovery demands, and other papers necessary to protect the City’s interests;– Monitoring applicable statutory and court–imposed deadlines; – Appearing on behalf of the City at conferences, compliance conferences, settlement conferences, hearings, motions, and trials;– Conducting discovery and responding to discovery demands;– Reviewing and analyzing appraisal reports, income and expense statements, comparable sales, capitalization rates, and other valuation evidence;– Assessment and Valuation Issues. The selected Proposer shall provide advice concerning legal issues relating to the assessment and valuation of real property, including, as appropriate:A. Challenges to the methodology used to establish or maintain assessments;B. Valuation of commercial, industrial, residential, mixed–use, and other real property;C. Income capitalization, comparable sales, cost, and other applicable valuation approaches;– Case Evaluation and Settlement. The selected Proposer shall regularly evaluate pending proceedings and provide the City with recommendations concerning litigation strategy and settlementA. The merits of the petitioner’s claim;B. The City’s litigation risks;C. The likely range of potential assessment reductions or tax refunds– Communication and Case ManagementA. Designate a principal attorney responsible for the City’s account;B. Provide the City with timely notice of significant developments, deadlines, conferences, settlement discussions, and court appearances;C. Promptly provide the City with copies of pleadings, motions, orders, decisions, stipulations, settlement documents, and other material case documents;
