Description
VTA seeks proposals (each a " Proposal ") from qualified firms (each a " Proposer ") to provide services to act as Construction Manager/General Contractor (“CMGC”) for the project titled below and further described in the Scope of Services, attached as Appendix A (the " Project "): Chaboya Yard Zero‑Emission Bus (ZEB) Charging Infrastructure Project The purpose of the Proposal is to demonstrate the qualifications, competence and capacity of Proposer to perform preconstruction services and, if a Guaranteed Maximum Price (“GMP”) can be agreed upon, to provide CMGC services for construction of the Project, as further described in this RFP, in conformity with the requirements of this RFP. The Proposal should demonstrate the qualifications of the Proposer and of the particular staff to be assigned to this Project. It should also specify a specific approach that will meet the RFP requirements. VTA intends to select and award a contract to a qualified, California-licensed General Contractor that is able to provide appropriately licensed contracting and professional services (“Construction Manager”) to collaborate with VTA’s retained design consultant (“Designer”) and provide Preconstruction Services, as defined below, during development of the Plans, Specifications, and Estimate (“PS&E”) for the Project. The project delivery method for this Project is CMGC in accordance with Public Utilities Code section 100150, et. seq. The successful Proposer will be expected to execute the Construction Manager/General Construction Manager Contract (“CMGC Contract” or “Contract”) attached to this RFP. VTA intends to award the construction services for the Project to the Successful Proposer after the plans have been sufficiently developed and if a GMP has been successfully negotiated. The Successful Proposer will execute the CMGC Contract for Preconstruction Services, and complete the Preconstruction Services within 240 calendar days after the date VTA issues the Notice to Proceed with the Preconstruction Phase. The scope of Preconstruction Services is contained in Appendix A: Scope of Services . If a GMP is agreed upon, the CMGC contract may be amended to authorize construction services to be completed by the Guaranteed Completion Date(s), as defined in and as shall be established in accordance with the CMGC Contract. The Successful Proposer awarded the Contract, if any, is referred to as the " Contractor” or “Construction Manager ". CMGC is being used to manage cost and risk, accelerate delivery, and support features not feasible under traditional Design‑Bid‑Build. Specific Project goals and objectives include: Meet the Project delivery schedule for Stage 1 Construction Services. As part of the PG&E’s EV Fleet Program that this Project is participating in, the medium‑voltage switchgear shall be installed no later than December 31, 2028; overall construction completion and system commissioning are targeted for Summer 2029. Deliver a high‑quality Project within the established construction budget (currently estimated between $15,000,000 - $20,000,000). Maintain Chaboya Division operations and maintenance throughout construction, including 24/7-yard access. Foster an effective partnership among VTA, Construction Manager, the Designer, and all stakeholders. The Construction Manager will work together with representatives from VTA's Engineering & Program Delivery (“EPD”) Division, VTA Operations Division, and the Designer. This collaborative approach is designed to foster inclusion and generate an efficient progression of the pre-construction services to construction. The Construction Manager will provide VTA and the Designer with expertise and experience assisting in decision-making; conducting constructability reviews; presenting and assessing design and construction phasing and schedule recommendations and innovations to meet the Project schedule and budget requirements; supporting and participating in optional, formal value engineering (VE) workshops; providing innovative Project delivery approaches; analyzing innovation or VE proposals and providing potential design and construction-related modifications, if proposed; supporting scope, budget, and schedule control (generally, the “Preconstruction Services”). VTA seeks assistance in ensuring that the design allows for economical and efficient methods of construction incorporating the most current and cost-effective technology with minimal disruption to yard operations. VTA intends to select a Construction Manager who can best provide the Preconstruction Services needed to achieve these objectives, and who can best complete the Project in accordance with VTA’s requirements. The Project has completed the Basis of Design report and 35% Preliminary Engineering drawing set, with selected components currently advancing to 65% PS&E. The Construction Manager shall collaborate with the Designer during the Preconstruction Services to optimize the design documents to incorporate the Construction Manager's recommended construction means and methods, provide continuous value engineering, continuously assess Project risks and develop mitigation measures, and optimize the construction phasing and schedule. The Preconstruction Services are described in detail in Appendix A: Scope of Services. The Preconstruction Services to be provided to VTA by Construction Manager consist of the following: • Task 1 – Project Management and Coordination • Task 2 – Preconstruction Services Designer Collaboration Task 3 may be authorized by written amendment, at VTA’s sole discretion, following approval of the applicable design and specifications and acceptance of an agreed upon price for the task. • Task 3 – Procurement of Long-Lead Items If any Construction Services required to complete the Project are identified in Task 4 and Task 5. • Task 4 – Delivery of Construction Phase Stage 1 Construction Services • Task 5 – Delivery of Construction Phase Stage 2 Construction Services Early construction packages may be issued to maintain overall schedule, including procurement of long‑lead items (e.g., medium‑voltage switchgear, transformers, charging cabinets, overhead pantograph dispensers). The initial contract award will be limited to Preconstruction Services (Tasks 1 and 2), based on a negotiated lump sum fixed fee. Authorization of Stage 1 or Stage 2 Construction Services is contingent on negotiation of a GMP, approval by VTA’s Board of Directors, and an amendment to authorize such services under the CMGC Contract is executed by both parties. Any decision to proceed with construction services will be in VTA’s sole discretion. Stage 2 Construction Services (Task 5) is further subject to funding availability. This RFP neither commits VTA to enter into such Contract nor obligates VTA to pay for costs incurred in preparation or submission of Proposals or in anticipation of entry into a Contract. In the event that a GMP is not negotiated, VTA may award a contract for construction services utilizing any other procurement method authorized by law.
