Description?
This is a Notice of Intent to Sole Source. This is not a formal Request for Quotes (RFQ) or a Request for Proposals (RFP), and no solicitation document is available. This notice does not represent a commitment by the Government to pay for costs incurred in the preparation and submission of any information. 1. Contracting Activity Department of the Army U.S. Army Corps of Engineers (USACE), Seattle District (CENWS) 4735 E. Marginal Way S., Bldg. 1202 Seattle, WA 98134-2385 2. Description of Requirement The U.S. Army Corps of Engineers (USACE) at the Libby Dam Project, 17877 Hwy 37 Libby, MT 59923, is modernizing its Main Unit Governors by replacing existing pressure switches with pressure transducers on five (5) units. The objective of this acquisition is to procure Original Equipment Manufacturer (OEM) programming, Programmable Logic Controller (PLC) / Human Machine Interface (HMI) development, and commissioning support from Emerson Process Management Power & Water Solutions, Inc. to accommodate this hardware change. The scope of work involves: The Contractor shall provide all specialized engineering labor, travel, and remote support necessary to modify the pump logic for five (5) units at the Libby Generating Station. The work consists of in-house development and testing, on-site commissioning for the first unit, and remote commissioning support for the remaining four units. Performing all work on-site on a rolling outage schedule as units become available between 1 September, 2026, and 30 August 2027. 3. Proposed Source & Sole Source Authority The Government intends to award a firm-fixed-price, sole-source contract to: Proposed Awardee: Emerson Process Management Power & Water Solutions, Inc. Unique Entity ID (UEI): SXN4KTNMCGN3 The Contracting Officer has determined that Emerson is the only source reasonably available to perform these services in accordance with Revolutionary Federal Acquisition Regulation Overhaul (RFO) 12.102(a) for acquisitions valued at or below the Simplified Acquisition Threshold (SAT). 4. Rationale for Restricting Competition Emerson is the Original Equipment Manufacturer (OEM) of the Libby Dam Main Unit Governor control system, having acquired the American Governor Company (previous designer and installer). Emerson retains sole proprietary rights to the system software, firmware, and diagnostic tools required to reprogram and calibrate the governors. Critical Operational Risk: The Main Unit Governors are critical infrastructure. Any modification or reprogramming of the control software performed by any entity other than the OEM (Emerson) will immediately void active system support and software lifecycles. Liability & Technical Support: Voiding OEM support forces the Government to assume 100% of the liability and maintenance responsibility for the turbine control software, introducing unacceptable risks to unit safety, operational reliability, and future troubleshooting. Market Research Conclusion: Market research has confirmed that there are no third-party providers authorized or capable of modifying this proprietary control software while maintaining the OEM warranty and support structure. 5. Submission Instructions for Interested Parties The Government believes that only one source, Emerson Process Management Power & Water Solutions, Inc., can satisfy this requirement. However, in accordance with federal regulations, the Government will consider written capability statements from interested parties. To be considered, responding firms must submit clear and convincing evidence/documentation demonstrating: Direct, authorized access to Emerson proprietary programming, calibration, and diagnostic software. Written certification from the OEM (Emerson) confirming that the responder’s modifications to the governor control software will not void, degrade, or terminate the existing OEM technical support and software maintenance agreements. Relevant corporate capability and experience performing similar governor programming on Emerson systems. Response Deadline: All responses must be submitted electronically via email to the Contract Specialist, Londres Medranda, at londres.medranda@usace.army.mil no later than 1:00 PM Pacific Time on 28 July 2026. A determination by the Government not to compete this proposed contract based on responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement in the future.
