This action is being awarded on a sole source basis to the Bell Boeing Joint Project Office in accordance with the statutory authority permitting other than full and open competition under Title 10 U.S.C. 3204(a)(1), as implemented by FAR Part 6.103-1, “…only one responsible source or only from a limited number of responsible sources and no other type of property or services will satisfy the needs of the agency.” Bell Boeing is the sole designer, developer, and producer of the V-22 Tiltrotor aircraft and is the only known source that possesses the requisite knowledge and expertise required to perform this effort. Also, Bell Boeing is the only source that possesses the totality of engineering and technical data required to perform these efforts. This notice of intent is not a request for competitive proposal. However, any capability statements will be considered by the Government. A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement.
