Description?
The Office of Mission Acquisition Solutions (OMAS), within the Assistant Secretary for Financial Resources (ASFR) at the U.S. Department of Health and Human Services (HHS), intends to execute a bulk administrative closeout of expired and physically completed contract actions. In accordance with FAR 4.804-5, the Government will finalize close-out of the contracts and orders listed in Attachment A. A contract is considered physically completed when: All deliverables have been received and accepted Final indirect cost rates have been settled, if applicable No outstanding claims or disputes remain OMAS’s acquisition portfolio includes expired purchase orders, contracts, task/delivery orders, BPAs, and BPA calls that are well past their period of performance and the FAR Subpart 4.8 closeout timeframes. To eliminate the backlog of zero-dollar awards, which burden legacy financial systems and hinder transition to modernized procurement systems, OMAS is implementing a streamlined, cost?effective process to close these files. Notice to Contractors The contractor is requested to review the attached list of contracts/orders. If your organization objects to the unilateral administrative closeout of any specific contract listed, you must submit a written notification detailing the objection. The notification must include: The specific Contract/Order Number. The reason for objection (e.g., pending invoices, outstanding claims, or undelivered items). Supporting documentation for the pending action. If no written objections are received by the response date listed above, the Government will proceed with the unilateral bulk administrative closeout of these actions. All records will be documented to show that there is no outstanding balance due to or from the contractor on these specific actions. This notice also serves as a Release of Liability for the Government; a copy will be placed in the official contract files. HHS is not aware of any outstanding invoices associated with the listed awards. Contractors retain all rights under 41 U.S.C. Chapter 71 (Contract Disputes Act of 1978) for filing claims. Normal FAR Subpart 4.8 retention requirements will apply once the awards are closed.
