The award, (hereinafter referred to as Award) will be between the City and awarded Bidder, (hereinafter referred to as Bidder) in accordance with the <strong>City General Terms &amp; Conditions</strong>, conditions and scope of work. This is a fully electronic solicitation &ndash; only electronic bids submitted through the City&rsquo;s online bidding system will be allowed; no other form of bid submittals will be accepted. Prior to submitting a bid, Bidders are advised to carefully read the instructions below, including the <strong>City General Terms &amp; Conditions</strong> and any solicitation attachments and/or exhibits. City intends to make an individual award to the supplier who provides the lowest responsive bid for the configured switch. However, the City does reserve the right to make a split award for those items if it is in the best interest of the Cit to do so. This bid must be for <strong>Brand new, factory sealed equipment only</strong>. No refurbished, used, or previously sold equipment. </p>",
